Texas AG rules DFS is "prohibited gambling"

s has become the latest state to have its attorney general (AG) rule that daily fantasy sports (DFS) classes as prohibited gambling under state law.

Ken Paxton, Texas AG, concluded that participating in a real-money DFS game constitutes as a bet, as the game is at least partially decided by chance and does not even need to be predominantly decided by chance.

Paxton said: “Simply put, it is prohibited gambling in Texas if you bet on the performance of a participant in a sporting event and the house takes a cut.”

The ruling partially resembles developments in New York and Illinois, where the state AG’s have also ruled that DFS classes as gambling.

However, no DFS operators have been asked or ordered to remove their operations from Texas as of yet, unlike the cases with New York and Illinois.
