The Mountain State has already launched retail sports wagering but the delay for the app, which will be operated by DraftKings, was announced by Lottery Director John Myers.

He stated both the companies and agency involved wanted to approach the situation with a great deal of caution, in order to remain in line with the Federal Wire Act.

On Monday, New Hampshire won its lawsuit against the Department of Justice, with a Judge issuing a 60-page opinion concluding the Wire Act will only apply to sports betting.

However, as sports wagering still falls under the Wire Act’s umbrella, West Virginia’s mobile launch has been delayed.

Last week, Indiana also announced the state’s sports betting may be delayed, due to the lengthy process of reviewing applications and casinos reaching agreements with vendors and data providers.
