SGA investigates potential to base penalty fees off GGR rather than gross turnover

BOS, the Swedish Trade Association for Online Gambling, believes the recent statements from The Supreme Administrative Court of Sweden are a step in the right direction.

The Supreme Administrative Court of Sweden has made a statement regarding the penalty fee to the gambling operator Genesis Global. 

Genesis was fined SEK 4m ($388,968) in March 2019 after an investigation found that it had failed to integrate its white-label brands into the self-exclusion system by Spelpaus.

Until this point, any fees implemented by the Swedish Gambling Authority have been based on gross turnover results and not gross gaming revenue (GGR), which usually accounts for less than 10% of the turnover.

Last Tuesday, the Supreme Administrative Court of Sweden released a statement regarding the possibility to base the fees on gross turnover instead, a position that BOS has held for a long time.

This may have a prejudicial effort on both future decisions and any past decisions made after regulation changes in 2019, with an investigation into this already underway.

Gustaf Hoffstedt, Secretary General of BOS, the Swedish Trade Association for Online Gambling said: “This decision is very welcome, albeit belated.

"That penalty fees should be based on GGR and not gross turnover should have been obvious from the start, since it is only GGR that the gambling company has at its disposal and can therefore use to pay any penalty fees.

"The rest of the money belongs to the gamblers and not the gambling company.”
