A bill seeking to regulate online poker in New York has been passed 53-5 by a Senate vote, but time is running out for the bill to be made law.

S5302 was introduced by Senator John Bonacic for the second consecutive year in May last year, but the bill differs from the previous effort in that it does not include a “bad actor” clause that would ban operators that conducted online poker business in the US after online gambling was made illegal in 2006.

Assemblyman Gary Pretlow reintroduced a senate version of the bill in January.

Despite the progress that has been made by S5302, which was passed by the Senate Finance Committee earlier this month, the stumbling block for the bill is that the current state legislative session adjourns on Thursday and Pretlow has declared the bill as “dead”, which he was reported as saying by Buffalo News.

New York is not listed as a state that has legislation carryover to 2017 and the best chance for online poker to move forward in the state this year is to be involved in an omnibus bill that would include a range of proposed legislative pushes.
