Broadway Gaming to pay £100,000 after UKGC investigation

Maltese licensed online gaming company Broadway Gaming Ltd has agreed to pay a £100,000 penalty package, following a UK Gambling Commission (UKGC) investigation which found it had failed to include “significant terms linked to promotional adverts found on five of its gambling websites.”

The company, which is licensed to operate remote gaming in the UK was in June 2016 the subject of an Advertising Standards Authority ruling in relation to an advert which appeared on the Broadway Gaming’s Butlers Bingo website.

Its advert, which offered players the chance to “Deposit £10, Play £35” was found to be in breach of Committee of Advertising Practice (CAP) Codes 8.17 and 8.17.1 surrounding the use of significant conditions for promotions, further stating that the advert was misleading as it did not communicate significant conditions for the promotion.

At the time, the ASA ruled that the advertisement should not appear again in its current form and ordered Broadway Gaming to take the advert down.

However a further investigation by the UK Gambling Commission found similar lapses on Broadway Gaming’s other websites including Bingo Diamond, Casino of Dreams, Dotty Bingo and Rehab Bingo.

In response Broadway Gaming has accepted that these adverts breached the Commission’s social responsibility codes which state that adverts must comply with the CAP code, with particular reference to the obligation to state significant limitations and qualifications relating to any promotion.

The agreed penalty package comprises a financial penalty in the sum of £100,000 for breaching its licence conditions, which includes a payment to cover the UKGC’s investigation costs and the full publication of a report relating to the investigation on the UKGC website as a learning tool for other firms within the remote gambling industry.
