In October 2021, the KSA found that the online site contained links that led to information about the company’s physical locations, which is against the law in the Dutch market.
On December 2, the authority noted that the “Remote Games of Chance Decree states that an online licence holder may not advertise on its website for services and goods other than those for which the licence has been granted.
“The decision could only be published today due to pending procedures.”
The KSA explained that Holland Casino has a monopoly licence in the Netherlands for offering physical casino games, which is a different licence from the one whereby it is allowed to offer online games of chance. Holland Casino has since taken measures to end the violation.
A statement from the KSA read: “The Board of the Gaming Authority instructs Holland Casino to remove and keep removed all advertising and recruitment activities for (activities in) branches of Holland Casino, on the (mobile) website for its online games of chance offer, by imposing a burden under duress.”
In a letter addressed to suppliers in the Dutch market, the regulatory body warned that this kind of bonus solution or feature is illegal in the Netherlands and should not be supplied to local operators.
The KSA noted that cashback bonuses allow players to win back part of their losses, which contributes to taking more risks as it lowers the financial threshold to gamble.
And last month, the KSA issued “instructions” to two online operators for violating the Money Laundering and Terrorist Financing (Prevention) Act – WWFT.
