Key points:
- The lawsuit related to the use of the Aviator name and logo
- Flutter will now be able to market and distribute Aviator-based online games
Flutter Entertainment and Aviator LLC have come to an agreement, bringing an end to a legal battle between the pair.
With this, the two companies have signed a long-term commercial partnership, which will involve Aviator-based online games being marketed and distributed internationally by Flutter.
This brings an end to a legal dispute between the two parties over the use of the Aviator name and logo as part of the crash game of the same name.
Aviator filed a lawsuit against the Spribe and Flutter-owned Adjarabet for registering its trademarks in bad faith and on the ground that these registrations infringed on Aviator’s copyright.
The Court of First Instance in Georgia ruled in Aviator’s favour, finding that that Spribe had committed copyright and trademark infringement, and so had invalidated trademark registrations.
Good to know: A High Court judgment last week ruled that Flutter-owned Sky Betting & Gaming unlawfully used the personal data of a customer for profiling and targeted marketing
This led to a ruling against Flutter and Spribe, with former Adjarabet shareholder Aviator awarded $330m as a result, and Adjarabet told to cease its use of the ‘Aviator’ titles for its flagship game.
It was revealed shortly after that Flutter was set to appeal this ruling, but now it appears an agreement has been made, with the signing of this long-term commercial partnership.
In the weeks following the winning of the case, Aviator did provide further details of the origins of the Aviator brand and logo, while it initiated an invalidation action against Spribe before the European Union Intellectual Property Office (EUIPO).
