Investigation into SkyCity Adelaide to resume

The investigation into SkyCity Adelaide Casino, which was halted recently, will resume after AUSTRAC legal proceedings were resolved last week.

Investigation into SkyCity Adelaide to resume

Hon Brian Martin AO KC will recommence an investigation into SkyCity Adelaide Casino after it was fined AU$67m (US$44m) by the Federal Court last week. 

As reported, the investigation, led by Judge Martin, was temporarily halted when anti-money laundering regulator AUSTRAC initiated legal proceedings against SkyCity Adelaide, accusing the casino of ‘serious and systemic non-compliance with anti-money laundering and counter-terrorism financing laws.’

Judge Martin stated that he could not assess the casino’s suitability to hold a licence until these proceedings were resolved. 

In response to the above-mentioned allegations, an independent monitor was then appointed by SkyCity Adelaide under the instructions of the Liquor and Gambling Commissioner, to monitor and ensure the casino meets its obligations regarding anti-money laundering, counter-terrorism financing and minimising gambling harm. 

The proceedings concluded with SkyCity Adelaide Casino being fined AU$67m by the Federal Court for offences against the Anti-Money Laundering and Counter-Terrorism Financing Act 2006. The Acting Liquor and Gambling Commissioner then asked Judge Martin to continue his investigation and SkyCity Adelaide was notified. The review is expected to be completed by the end of the year.

The development was in parallel with the Malinauskas Government’s proposal for stronger casino laws. The new laws would increase the maximum fines for licensees from AU$100,000 to up to AU$75m for disciplinary actions taken by the Liquor and Gambling Commissioner. These provisions will apply to both past and future conduct and will ensure that penalties imposed by a court are considered when determining additional disciplinary actions.
