HMRC authorises prosecution of former GVC CEO Kenny Alexander and 10 others

The Crown Prosecution Service (CPS) has authorised the prosecution of 11 individuals linked to bribery, conspiracy to defraud, fraudulent trading, cheating the public revenue, evasion of income tax, acting as a director of a company when undischarged bankrupt and perverting the course of justice.

HMRC launched its investigation into the Turkey-facing business of GVC after it suspected the operator breached Section 7 of the Bribery Act 2010.

After GVC rebranded to Entain, the company set aside £585m ($746.3m) as part of discussions with CPS, making it one of the largest fines in the industry at the time.

The charges

Kenny Alexander, former GVC CEO, has been charged with conspiracy to defraud and conspiracy to bribe, as has Richard Cooper, former CFO, and Lee Feldman, former Chair of GVC.

Robert Douglas Edwin Dowling, Raymond Matthew Smart, Richard Anthony Raubitschek-Smith and James Patrick Humberstone have also been charged with the same offences.

Alexander MacAngus has been charged solely with conspiracy to defraud.

Meanwhile, Scott William Masterton has been charged with conspiracy to defraud, conspiracy to bribe, fraudulent trading, cheating the public revenue and acting as a Director of a company when undischarged bankrupt.

Caroline Patricia Roe has been charged with conspiracy to defraud and conspiracy to bribe, fraudulent trading and fraudulent evasion of income tax, and Robert Hoskin has been charged with perverting the course of justice.

Good to know: Entain has also issued a press release saying it “has no further comment to make in respect of these matters, which are the subject of ongoing criminal proceedings and reporting restrictions”

Hannah von Dadelszen, CPS Chief Crown Prosecutor, said: “The Crown Prosecution Service has authorised the prosecution of 11 individuals for seven offences relating to bribery, conspiracy to defraud, fraudulent trading, cheating the public revenue, evasion of income tax, acting as a director of a company when undischarged bankrupt and perverting the course of justice.

“These offences relate to the provision of gambling services in Turkey between 2011 and 2018.

“Our prosecutors have worked closely with officers of HM Revenue and Customs who have carried out the investigation.

“The Crown Prosecution Service reminds all concerned that criminal proceedings against these defendants are active and that they have a right to a fair trial. It is extremely important that there should be no reporting, commentary or sharing of information online which could in any way prejudice these proceedings.”

Richard Las, HMRC’s Fraud Investigation Service Director, said: “This has been a complex and international investigation.

“These are serious charges that relate to conspiracy to defraud, bribery, cheating the public revenue, evasion of income tax and perverting the course of justice among others.

“We remind everyone that proceedings are now active and we won’t be adding anything further.”
