MGA to repeal ODR Platform requirement under revised EU regulation

The Malta Gaming Authority (MGA) has announced that it will repeal Article 13 of its Alternative Dispute Resolution Directive (Directive 5 of 2018), effective from 20 July 2025.
The decision requires all online B2C licensees to remove references to the European Union’s Online Dispute Resolution (ODR) Platform from their terms and conditions.
The change comes in response to the adoption of Regulation (EU) 2024/3228, which formally repeals the previous Regulation (EU) No 524/2013 and provides for the discontinuation of the ODR platform.
The platform had served as an online resource for consumers seeking to resolve disputes with businesses in the EU.
According to the MGA, licensees must ensure that any mention of the ODR Platform is removed from user-facing materials, to prevent confusion or the appearance of outdated compliance references.
The Authority has advised licensees to refer directly to the updated EU Regulation to understand any new or residual compliance obligations.

This regulatory update follows the publication of the MGA’s 2024 annual report, which outlined a total of 17 new licences granted and over 3,300 player complaints addressed.
The Authority posted €84.1m ($90.3m) in revenue and reported an increase in its overall operating surplus for the year.
All licensees have been instructed to implement the required changes by the effective date to avoid regulatory breaches and ensure that players are provided with accurate and up-to-date information regarding their rights and dispute resolution mechanisms.
