The Curaçao Gaming Authority (CGA) has issued a statement regarding illegal gaming in the nation and its intention to tackle it.

The authority brought up article 1.2 (1) of the National Ordinance for Games of Chance (LOK), which states: “Without, or contrary to, a CGA-issued gaming license, or without any other legal authority to do so, it is not allowed to organise, or provide the opportunity to play, any game of chance in or from Curaçao.” Curaçao-based and licensed operators can only offer online gaming.

The CGA acknowledged that many Curaçao-registered companies hold foreign B2B licences. This practice is both illegal and misleading to players and providers, which may in turn lead to other companies facilitiation illegal gaming.

This may also violate Curaçao’s Criminal Code. The regulator went on to add that it will issue formal cease-and-desists to all Curaçao-registered businesses using foreign licences in the coming days.

Good to know: BC.Game attained a Curaçao licence via Curaçao’s LOK framework in April 2024.  

The move comes as Curaçao attempts to step up its regulatory oversight on companies operating in the nation. Historically, the nation has been somewhat lax on the matter, but with this statement seems to be attempting to change this.

The LOK framework was approved by Curaçao’s parliament in December 2024, having first been introduced to parliament two years prior. This overhauled the initial framework for regulating online gaming that was introduced in the 90s, when gaming was first going online.
