Brian Quintenz, nominated earlier this year by President Donald Trump to chair the Commodity Futures Trading Commission (CFTC), has published a series of private text messages on X with Gemini co-founder Tyler Winklevoss. 

Quintenz said he took the step to counter what he described as misleading impressions of his role and intentions.

Quintenz said: “I’ve never been inclined to release private messages. But in light of my support for the President and belief that he might have been misled, I’ve posted here the messages that include the questions Tyler Winklevoss asked me pertaining to their prior litigation with the CFTC.”

The messages show Winklevoss asking why the CFTC pursued enforcement against Gemini rather than other exchanges, as well as criticisms of the agency’s handling of whistleblower complaints.  

Quintenz replied that such issues were already argued in court or could not be raised there.

Quintenz stated: “The CFTC totally abused the deliberative process privilege amongst many other abuses to prevent us from even being able to defend ourselves fairly in court.”

Good to know: Quintenz’s nomination vote has already been delayed twice in the Senate. He previously testified in June that Native American Tribes remained free to apply for CFTC approval to operate event contract markets

Quintenz said the exchange made clear “what they were after from me and what I refused to promise,” claiming that following these conversations, Gemini representatives contacted the President and urged a pause on his confirmation for reasons unrelated to the texts themselves. 

The release of the private messages comes amid heightened political and regulatory scrutiny. In August, Congresswoman Dina Titus of Nevada asked the CFTC Inspector General to open an investigation into Quintenz’s ties to prediction market operator Kalshi, where he served on the board and held stock options. Titus argued that the arrangement could represent a conflict of interest given the CFTC’s oversight of event contracts.

Quintenz has denied any wrongdoing and emphasised that “transparency and integrity are paramount.” He added that his decision to release the messages was motivated by a desire to protect the President’s agenda.

The CFTC has not commented on the publication of the messages.
