India: Former MP DP Yadav discharged in Delhi online betting case

Key points:

– Case linked to 2015 Bhajanpura betting raid

– No witnesses or direct evidence against Yadav

– Court rejects reliance on call records alone

A Delhi court has discharged former Member of Parliament DP Yadav from a 2015 case involving an alleged online betting racket, citing insufficient evidence to frame charges. As reported by The Times of India, the ruling came from the court of Additional Chief Judicial Magistrate Vaibhav Chaurasia on Tuesday.

The prosecution had connected Yadav to a website-based gambling operation, GAME, which was raided in northeast Delhi’s Bhajanpura area in August 2015. Fourteen individuals were arrested on site, and items including over Rs 13.24 lakh (US$159,000) were confiscated. Authorities claimed that certain individuals had posed as government officials to lend legitimacy to the operation.

One of the arrested suspects reportedly claimed to work for Yadav and alleged that he received 40% of the profits. However, the court noted there was no corroboration of these claims. In his ruling, Magistrate Chaurasia stated that Yadav’s name appeared to have been used “to inculcate fear among rivals,” and that “mere suspicion” was not a valid basis for formal charges.

Good to know: The charges were initially filed under the Indian Penal Code, the Information Technology Act and the Public Gambling Act

The Court also accepted the argument from Yadav’s legal team that call detail records alone could not substantiate involvement. It emphasised the absence of any witness testimony or direct evidence linking the former MP to the gambling activity.

The discharge brings a close to a case that had lingered for nearly a decade.
