The Supreme Court of India has reserved its verdict in a high-stakes legal matter concerning the applicability of Goods and Services Tax (GST) on online real-money gaming platforms. The total tax claim in dispute is estimated at RS 2.5 lakh crore (US$29bn), making it one of the largest in Indian legal history.

As reported by LawChakra, the Centre requested an additional week on 26 August to file supplementary submissions, following an earlier extension. Government counsel Chandrashekara Bharathi made the request during a hearing before a bench comprising Justices J.B. Pardiwala and R. Mahadevan.

The case involves major operators such as Gameskraft and Delta Corp, along with industry bodies including the All India Gaming Federation (AIGF), E-Gaming Federation (EGF) and Federation of Indian Fantasy Sports (FIFS). These petitioners argue that online skill-based games are fundamentally different from gambling or betting and should not fall under the same GST framework.

Senior advocates appearing on behalf of the gaming platforms cited constitutional protections and criticised the government’s classification of game stakes as “actionable claims” under GST law.

They also rejected the use of casino-based tax methods such as “House Advantage,” calling it speculative and lacking statutory basis.

The outcome of this case is expected to significantly impact the regulatory environment for online gaming businesses in India, as well as clarify the legal boundaries between skill-based entertainment and chance-based gambling for taxation purposes.
