Malaysia: Three Indonesians fined over illegal online gambling operation

Key points:

– Three Indonesian nationals fined RM10,000 (US$2,350) each for gambling offences

– Raid uncovered use of smartphones and computers as online gambling devices

– Two of the accused also sentenced to prison and caning for illegal entry

Three Indonesian men were fined RM10,000 each by the Magistrates’ Court in Kuching after admitting to operating illegal gambling machines from a residential apartment. The court ordered a six-month jail term in default of payment.

Florianus Jeky Chen, 25, Shu Chian, 22, and Asrul, 21, pleaded guilty to charges under Section 4B(a) of the Common Gaming House Act 1953, read in conjunction with Section 34 of the Penal Code. The offences took place at an apartment unit on Jalan Penrissen, Mile 4, on 23 July at approximately 11am.

During the Op Dadu raid, police discovered the accused using desktop computers and mobile phones linked to gambling activities. The devices were later confirmed by forensic examination to be used for online gambling purposes.

In a related development, the Sessions Court separately sentenced Florianus and Asrul to three months’ imprisonment and one stroke of the cane each after they pleaded guilty to entering Malaysia without valid documentation. The charge was framed under Section 6(1)(c) of the Immigration Act 1959/63, punishable under Section 6(3) of the same Act.

Good to know: The offence carries a maximum fine of RM100,000 per machine and a jail term of up to five years, signalling the severity with which Malaysian authorities treat illegal gambling

Checks conducted during the raid confirmed the two had no official records with the Immigration Department. All three individuals were unrepresented during the court proceedings.

Authorities continue to tighten enforcement under ongoing anti-gambling operations, particularly in urban residential areas believed to be used as covert call centres.
